“An employee requests a reduction in working hours for a few months in order to attend university courses. The employee’s regular working hours are 9 AM to 2 PM and 3 PM to 5.30 PM. And the reduced shift requested is 8 AM to 2 PM. The request has been made pursuant to Article 23.1 of the Spanish Statute of Workers Rights.
More precisely, the client wants to know whether it, as the employer, is under an obligation to grant the request, and how it should be done in practice. In addition, the employee is in charge of the switchboard, but the switchboard hours start at 9 AM instead of 8 AM when he is requesting to start work in the morning.
A colleague of the employee’s working at the same department has been granted a reduction in working hours from 8 AM to 2 PM for her maternity leave.”
